Terms of Service

Effective date: November 4, 2026

These terms are an agreement between you and FMW Inc. (“we”, “us”), a Canadian corporation. They cover the GasHawk mobile app (called PetrolHawk in the United Kingdom), its servers and this web site (together, “GasHawk”).

By using GasHawk, you agree to these terms. If you don’t agree, don’t use it. Our privacy policy explains how we handle your personal information.

Please read GasHawk is provided as is and Limits on our liability carefully. They limit what you can claim from us. Your country’s consumer laws may give you rights these terms can’t take away.

Who can use GasHawk

You must be at least 13, or the age at which you can consent to online services on your own where you live, if that is higher (14 in Spain and Italy, 15 in France). If you are a minor where you live, a parent or guardian must agree to these terms for you.

You can use GasHawk without an account. If you create one, keep your sign-in details safe and tell us if you think someone else is using it. You are responsible for what happens under your account.

Prices and station information may be wrong

GasHawk shows information from drivers, from publicly available sources and from stations’ own reports to government price services. We don’t set prices, sell fuel or operate stations, and we don’t check every piece of information before it appears.

Anything shown in GasHawk may be wrong, incomplete, out of date or missing, including:

• Prices. The price at the pump can differ from the price in the app. The pump is always right.
• Station details. A station may be closed or out of a fuel, or have different hours, grades or amenities than shown.
• Forecasts. A forecast is an estimate. Prices may not move as predicted, or at all, and a forecast may be late or unavailable.
• Alerts. Alerts may arrive late or not at all, and they depend on notification services we don’t control.
• Routes, detours and savings. Routes come from third parties and may be unsuitable or unsafe. Detour and savings figures, including full-tank prices, are estimates that don’t account for everything a trip costs you.
• Reliability labels. Labels such as Reliable, Mixed and Often wrong summarize recent checks by drivers. They are not our statement of fact about a station or its operator.
• Points, levels and the leaderboard. These may change or be corrected at any time. They have no cash value.

Always check the price and the fuel grade at the pump before you fill up. Don’t decide to make a trip based on GasHawk alone if running out of fuel or finding a station closed would be a problem for you.

Use it safely

Don’t use GasHawk in a way that takes your attention off driving. Set up your route before you leave, or have a passenger use the app. Obey traffic laws and road signs, even if the app or a route suggests otherwise. Follow the rules at the station, including any rules about using a phone near the pumps.

What you post

“Contributions” are the prices, confirmations, votes, reviews, station edits, notes and other content you submit.

• You own your contributions, and you give us a licence to them. You give us a worldwide, perpetual, irrevocable, royalty-free, transferable licence, which we can sublicense, to use, copy, change, display and share your contributions to run, improve and promote GasHawk. Where the law allows, you also agree not to assert any moral rights against us for those uses.
• They can outlast your account. As the privacy policy explains, prices you reported stay as community price history after you delete your account, without your name.
• They must be honest. Only report what you actually saw. You are responsible for your contributions, and you promise you have the right to submit them.
• We can moderate them. We can hold, hide, edit or remove any contribution, and we have no duty to do so. Views in reviews and notes belong to the people who wrote them, not to us.

Rules

We have zero tolerance for objectionable content or abusive users. You must not:

• Submit false prices or fake reviews, or manipulate prices, votes, points, the leaderboard or a station’s reliability label.
• Post anything illegal, defamatory, hateful, harassing, sexually explicit, threatening or misleading, or anything that infringes someone else’s rights or shares their private information.
• Misrepresent your location, or pretend to be someone else.
• Scrape, copy or resell GasHawk’s data, or build a competing service or data set from it, including through automated access, except where the law allows it regardless of these terms.
• Reverse engineer GasHawk, bypass its security, app checks, rate limits or paywalls, or interfere with its operation.
• Use GasHawk for any unlawful purpose.

To report objectionable content or abuse, email [email protected]. We may remove the content and suspend or close the account or install responsible.

GasHawk Pro

GasHawk Pro is a paid subscription, monthly or yearly, that unlocks extra features. The features listed in the app are what Pro includes today; they, and where they are available, may change over time. Some features aren’t available in every country.

• Payment and renewal. Apple or Google takes your payment, and the price is shown before you buy. Your subscription renews automatically at the end of each period until you cancel it. We will give any notice of a price increase that the app store’s rules or the law require.
• Cancelling. Cancel in your App Store or Google Play subscription settings at least 24 hours before renewal. Your subscription stays active until the end of the period you have paid for. Deleting your account or the app doesn’t cancel it.
• Refunds. Apple and Google handle refunds under their own policies, and we can’t issue them ourselves. See Support for how to ask. Except where the law or the store’s policy says otherwise, payments aren’t refundable.

Our rights in GasHawk

GasHawk, including its software, design, compiled data and the GasHawk and PetrolHawk names and logos, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use, under these terms and the rules of your app store. Station brands and logos belong to their owners, and showing them doesn’t mean those owners endorse or work with us.

GasHawk relies on third-party services such as maps, sign-in, notifications and app stores. Their own terms apply to your use of them, and we aren’t responsible for them.

Changes, suspension and closing your account

We may change, suspend or stop all or part of GasHawk at any time, including data for a station, a region or a country, because our sources or the law may change. We may suspend or close your access if you break these terms or if we need to in order to protect GasHawk, other users or the public.

You can stop using GasHawk at any time, and you can delete your account in Profile → Settings → Delete account. If we permanently stop GasHawk Pro while you have a paid period left, you can ask the app store for a refund, or contact us.

GasHawk is provided as is

GASHAWK, INCLUDING GASHAWK PRO AND ALL INFORMATION IN IT, IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND.

TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY OR ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, INCLUDING ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT.

WE DO NOT PROMISE THAT GASHAWK WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, SECURE, UNINTERRUPTED OR FREE OF ERRORS OR HARMFUL COMPONENTS, THAT IT WILL MEET YOUR NEEDS, THAT YOU WILL SAVE MONEY BY USING IT, OR THAT DEFECTS WILL BE FIXED. NOTHING WE OR ANYONE ELSE TELLS YOU ABOUT GASHAWK, IN THE APP, IN A STORE LISTING, IN SUPPORT OR ANYWHERE ELSE, CREATES A WARRANTY.

YOU USE GASHAWK AT YOUR OWN RISK.

Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

• WE, OUR DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS AND DATA SOURCES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST SAVINGS, LOST DATA, OR LOSS OF TIME OR GOODWILL.
• WE ARE NOT LIABLE FOR ANY LOSS ARISING FROM WRONG, MISSING OR LATE INFORMATION OR ALERTS, INCLUDING PAYING A HIGHER PRICE, A WASTED TRIP OR DETOUR, FUEL OR TRAVEL COSTS, RUNNING OUT OF FUEL, BUYING THE WRONG FUEL OR VEHICLE DAMAGE; FROM ACCIDENTS OR TRAFFIC OFFENCES; FROM CONTRIBUTIONS OR THE CONDUCT OF ANY USER, STATION OR THIRD PARTY; OR FROM ANY INTERRUPTION OR LOSS OF ACCESS TO GASHAWK.
• OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO GASHAWK OR THESE TERMS IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID FOR GASHAWK PRO IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM AND (B) CA$50.

THESE LIMITS APPLY WHATEVER THE LEGAL THEORY OF THE CLAIM (INCLUDING CONTRACT, WARRANTY, TORT, NEGLIGENCE OR STRICT LIABILITY), EVEN IF WE WERE TOLD THE LOSS WAS POSSIBLE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Your responsibility to us

To the extent the law allows, you agree to cover our losses and reasonable legal costs from any claim by someone else that arises from your contributions or from your breaking these terms or the law. This doesn’t apply to the extent we caused the loss.

Apple

If you got the app from Apple’s App Store: these terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content. Your licence is limited to Apple-branded devices you own or control, as the App Store’s usage rules allow.

Apple has no duty to provide maintenance or support for the app. If the app fails to meet a warranty that applies by law, you can notify Apple and it will refund any purchase price you paid for the app; to the extent the law allows, Apple has no other warranty obligation for it. Apple isn’t responsible for addressing claims from you or anyone else about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone’s intellectual property.

You confirm that you aren’t in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you aren’t on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

Disputes

The laws of Ontario and the federal laws of Canada that apply there govern these terms, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods doesn’t apply. The courts of Ontario have jurisdiction over disputes about these terms.

If you are a consumer, this doesn’t take away the protection of the mandatory laws of the place you live, and you can also bring a claim in the courts there if those laws give you that right.

Changes to these terms

We will post changes here with a new effective date. For significant changes, we will notify you in the app before they take effect, at least 30 days ahead where the law requires it. If you don’t agree to a change, stop using GasHawk and cancel any subscription before it takes effect; where the law gives you the right to end the contract and be refunded for a change, you keep that right. If you keep using GasHawk after the change takes effect, the new terms apply.

General

These terms and the privacy policy are the whole agreement between you and us about GasHawk. If a court finds part of these terms unenforceable, the rest stay in force. If we don’t enforce a term, we can still enforce it later. You can’t transfer these terms; we can transfer them to whoever takes over GasHawk, as long as your legal rights aren’t reduced. The sections on your contributions, warranties, liability, your responsibility to us, disputes and this one continue after you stop using GasHawk.
